Dear Sirs,
Rafineria Gdańska Sp. z o.o. is pleased to invite you to take part in a tender procedure concerning methylodietanolamine (MDEA) for its 9850 unit. Please find below all the information needed.

1. Subject matter of the invitation

A. The purchase of MDEA according to the inquiry below:
  • Product: MDEA (methylodietanolamine) + material analysis / properties:
  • Purity: min 99%
  • Quantity: ca 60t
  • Packaging: in bulk, 3 trucks a ca 20 t
  • Product status: EU
  • Please attach updated MSDS to the offer.


B. The Supplier will be obliged to conduct two sets of laboratory tests of Lean amine (total 2 samples) within one year from the date of the first MDEA delivery.
Please find below the needed list of analysis:
  • Sample appearance
  • pH
  • Determination of free and bonded amine
  • Water content
  • Acid gas loading
  • Foam test
  • Activator content
  • Metal scan
  • Identification and quantification of amine degradation products
  • Identification and quantification of heat stable amine salts
  • Total suspended solids
  • Hydrocarbons
Supplier must also provide proper packaging for samples e.g.: cardboard box with UN inscriptions, cans / bottles / SDS for lean amine. Cost of the amine tests should be included in amine cost. Buyer will cover shipping costs of the samples to the laboratory indicated by the Supplier.

2. Date of delivery of the subject matter:
Preferred delivery date month after signing Purchase Order.
The dates will be confirmed by Rafineria Gdańska after selection of an offer. Please include in your offer the delivery time in working days from the receipt of the signed order.

3. Terms of delivery: DAP Rafineria Gdańska Sp. z o.o. , ul. Elbląska 135, unit 9850, according to Incoterms 2020

4. Terms of payment: 30 days after issuing the invoice

5. Tender content and form:
Questions should be asked only via the Logintrade Purchasing Platform within terms indicated in the inquiry. Questions asked after the deadline will not be answered. Answers will be given to all participants to the procedure after the expiry of the deadline for asking questions in a form of an update to the invitation to tender.
Tenderers may submit a tender only via the Logintrade Purchasing Platform. A complete tender should consist of two parts – a substantive, technical part and a commercial one. The tender should be drawn up in Polish or English.
The substantive and technical part should include:
Technical information required in the inquiry, excluding the price, including:
  • confirmation of compliance with the technical requirements for the product,
  • the date of implementation from the moment of calling the demand
  • MSDS’s of products in Polish
  • CN codes
  • Attachment 1 - Sanctions statement (filled out and signed)
  • Attachment 2 - Rafineria_Gdańska_REACH_and_CLP_supplier_statement (filled out and signed)
  • Confirmation of sending the certificate for each delivery
  • A scan of: Power of proxy to submit the offer. In case of foreign entities – a certificate of residency.
In order for a commercial tender to be reviewed it must comply with technical requirements.
The commercial part should include:
  • price per 1 kilogram of product for delivery under the terms of DDP Refinery Gdansk Sp. z o.o.
All prices indicated in the tender should be net prices (excluding VAT).
Formal documents
Along with the commercial offer, the Tenderer can be asked to provide scans of the following documents:
• registration document,
• NIP certificate,
• Certificates of granting REGON,
• Powers of attorney to submit an offer,
• In the case of foreign entities - certificate of residence.
In addition:
• Certificate of no arrears in taxes not older than 3 months (issued by the Tax Office, applies to the Republic of Poland),
• Certificate of non-arrears in the payment of contributions from the Social Insurance Institution, not older than 3 months,
• Permit / concession or a declaration that the business activity does not require them,
• Financial statement for the last financial year (if required), CIT-8, PIT-B declaration or other document presenting
the contractor's financial situation,

6. A tenderer can modify or withdraw its tender with no legal consequences, under the condition that it submits its written request for that before the final deadline for tender submission. After withdrawing its tender, the Tenderer may submit a new tender, under the condition that it is submitted before the final deadline for tender submission. Rafineria Gdańska sp. z o.o. reserves the right to modify the terms of the invitation before the final
deadline for tender submission.

7. Rafineria Gdanska Sp. z o.o. reserves the right to cancel the contractor selection process, close the process without selecting a contractor, and the possibility to negotiate with the selected bidder or bidders until the contract/order is signed. The selection of of the bidder(s) for further negotiations does not constitute acceptance of the offer or settlement of the tender within the meaning of the Civil Code. In such case case, the Bidder(s) shall not be entitled to any financial claims against the Contracting Authority.

8. Rafineria Gdańska sp. z o.o. reserves the right to accept/reject tenders partially or completely as well as to change the number of items referred to in the specification.

9. The Contracting Authority shall reject bids that contain an abnormally low price, in accordance with the information attached to the Request for Proposal.

10. All information presented herein is intended solely for the purpose of preparing the Offer and in no case should be used in any other way and for other purposes.

11. Rafineria Gdańska Sp. z o.o. reserves the right to accept/reject the Offer in whole or in part.

13. Sanction clauses
 In accordance with the sanctions legislation issued in response to the aggression against Ukraine , in particular:
- Council Regulation (EU) No 833/2014 of 31 July 2014, concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (Official Journal of the EU. L No 229, p. 1, as amended),
- Council Regulation (EC) No 765/2006 of 18 May 2006, concerning restrictive measures against President Lukashenko and certain officials of Belarus (Official Journal of the EU. L No 134, p. 1, as amended), and
- Council Regulation (EU) 2022/263 of 23 February 2022 concerning restrictive measures in response to the recognition of the non-government controlled areas of the Donetsk and Luhansk oblasts of Ukraine and the ordering of Russian armed forces into those areas (Official Journal of the EU. L.2022.42l, p. 77, as amended),
- Council Regulation (EU) No 692/2014 of 23 June 2014, concerning restrictions on the import into the Union of goods originating in Crimea or Sevastopol, in response to the illegal annexation of Crimea and Sevastopol (Oficcial Journal of the EU. L. No 183, p. 9, as amended,
The offeror, by entering the procurement process and submitting an offer in response to this request for proposal, guarantees that the goods (including goods supplied as part of the services provided) which would be purchased by Rafineria Gdańska Sp. z o.o. as a result of execution of the submitted offer, will not be sourced from or imported from Russia or Belarus or Lugansk or Donetsk regions (territories of Ukraine).
Under pain of being declared null and void, please enclose the signed statement from the appendix.

After the contractor selection process is completed, information on the result will be sent to the participating bidders.
