Dear Sirs,
Rafineria Gdańska Sp. z o.o. is pleased to invite you to take part in a tender procedure concerning methylodietanolamine (MDEA) for its 9850 unit. Please find below all the information needed.

1. Subject matter of the invitation
A. The purchase of MDEA according to the inquiry below:
• Product: MDEA (methylodietanolamine) + material analysis / properties:
• Purity: min 99%
• Quantity: ca 60t
• Packaging: in bulk, 3 trucks a ca 20 t
• Product status: EU
• Please attach updated MSDS to the offer.

B. The Supplier will be obliged to conduct two sets of laboratory tests of Lean amine (total 2 samples) within one year from the date of the first MDEA delivery.
Please find below the needed list of analysis:
• Sample appearance
• pH
• Determination of free and bonded amine
• Water content
• Acid gas loading
• Foam test
• Activator content
• Metal scan
• Identification and quantification of amine degradation products
• Identification and quantification of heat stable amine salts
• Total suspended solids
• Hydrocarbons
Supplier must also provide proper packaging for samples e.g.: cardboard box with UN inscriptions, cans / bottles / SDS for lean amine. Cost of the amine tests should be included in amine cost. Buyer will cover shipping costs of the samples to the laboratory indicated by the Supplier.

2. Date of delivery of the subject matter:
Preferred delivery date March/April 2023
The dates will be confirmed by Rafineria Gdańska sp. Z o .o. after selection of an offer. Please include in your offer the delivery time in working days from the receipt of the signed order.

3. Terms of delivery:
DAP Rafineria Gdańska Sp. z o.o. , ul. Elbląska 135, unit 9850, according to Incoterms 2020

4. penalty clauses
In connection with the prohibitions set out in the sanction regulations issued in connection with the aggression against Ukraine , in particular:
- Council Regulation (EU) No. 833/2014 of July 31, 2014 concerning restrictive measures in connection with Russia's actions destabilizing the situation in Ukraine (Official Journal of the EU.L No. 229, p. 1, as amended),
- Council Regulation (EC) No. 765/2006 of May 18, 2006 concerning restrictive measures in view of the situation in Belarus and Belarus' participation in Russia's aggression against Ukraine (OJ.Urz.EU.L No. 134, p. 1, as amended),
- Council Regulation (EU) 2022/263 of February 23, 2022 on restrictive measures in response to the recognition of the non-government-controlled areas of Ukraine's Donetsk and Luhansk regions and the ordering of the deployment of Russian military forces in these areas (OJ.EU.L.2022.42I, p. 77, as amended), and
- Council Regulation (EU) No. 692/2014 of June 23, 2014 on restrictive measures in response to the unlawful annexation of Crimea and Sevastopol (OJ.Urz.EU.L. No. 183, p. 9, as amended),
the bidder entering the purchase procedure and submitting an offer in response to this request for proposal guarantees that the products to be purchased by Rafineria Gdanska Sp. z o. o. as a result of the submitted offer will not originate or be exported from Russia or Belarus or Lugansk or Donetsk regions or Crimea or Sevastopol (territories of Ukraine).
We also ask, under pain of invalidity of the submitted offer, to attach in the substantive part of the signed statement from Appendix No. 1.

5. Form and content of the bid:
5.1 Substantive questions
All substantive questions regarding the technical specifications should be asked via the Logintrade purchasing platform.
Contact outside the designated path, may result in the exclusion of the supplier from this contractor selection procedure.
5.2 Technical questions related to the operation of the Logintrade platform

5.3 Submission of bids
The Bidder shall submit an offer exclusively through the Logintrade Purchasing Platform. Along with the offer, it is absolutely required to confirm the requirements set forth in the content of the request for quotation and to clearly indicate any deviations from the requirements, if any.
The offer should be prepared in Polish or English.

The substantive (technical) part must include:
  - Technical information required in the inquiry, excluding the price, including:
  - attaching confirmation of compliance with the technical requirements for the product,
  - sending the SDS and technical specification in Polish,
  - providing the date of implementation from the moment of calling the demand
  - filling in a STATEMENT regarding the fulfillment of selected requirements of the REACH regulation,
  - confirmation of sending the certificate for each delivery
  - indication of the CN code.

The commercial part must include:
a. Price per 1 ton of product for delivery by tanker under the conditions of DDP Refinery Gdansk Ltd,
b. Signed attachments - Statements

Formal documents
Along with the commercial offer, the Tenderer will provide scans of the following documents:
• registration document,
• NIP certificate,
• Certificates of granting REGON,
• Powers of attorney to submit an offer,
• In the case of foreign entities - certificate of residence.
In addition:
• Certificate of no arrears in taxes not older than 3 months (issued by the Tax Office, applies to the Republic of Poland),
• Certificate of non-arrears in the payment of contributions from the Social Insurance Institution, not older than 3 months,
• Permit / concession or a declaration that the business activity does not require them,
• Financial statement for the last financial year (if required), CIT-8, PIT-B declaration or other document presenting
 the contractor's financial situation,

6. Rafineria Gdańska Sp. z o.o. reserves the right to cancel the contractor selection process, close the process without selecting a contractor, and the possibility to negotiate with the selected bidder(s) until the contract/order is signed. The selection of the bidder(s) for further negotiations does not constitute acceptance of the offer or settlement of the tender within the meaning of the Civil Code. In such case, the Bidder(s) shall not be entitled to any financial claims against the Contracting Authority.

7. The Contracting Authority shall reject bids containing an abnormally low price, in accordance with the information attached to the Request for Proposal.

8. all information presented herein is intended solely for the purpose of preparing the Offer and in no case should be used in any other way or for any other purpose.

9. Rafineria Gdańska Sp. z o.o. reserves the right to accept/reject the Offer in whole or in part.

10. The General Terms and Conditions of Procurement available at the link: https://www.lotos.pl/repository/55119/ shall apply to orders.

Upon completion of the contractor selection process, information on the result will be sent to the bidders participating in the procedure.
